The Scope and Purpose of this Privacy Notice

The Law Office of Stacy J. Grossman PLLC (the “Firm” or “we”) takes your personal privacy interests seriously. This Privacy Notice explains how the Firm collects, uses, shares and otherwise processes your Personal Data in accordance with applicable data privacy laws and the General Data Protection Regulation (“GDPR”) in connection with your relationship with the Firm as a client, as someone acting on behalf of a Firm client, or as someone with a general interest in our services and our publications. The GDPR will take effect on May 25, 2018.

We recognize that information privacy is an ongoing responsibility, and will, from time to time, update this Privacy Notice as it undertakes new personal data practices or adopt new privacy policies.

The Personal Data We May Collect About You

The kinds of Personal Data the Firm may collect include:

  • contact information, such as name, job title, email address, mailing address, or telephone number;
  • information about your business, such as company name, company size, or business type;
  • information provided in the course of the provision of legal services (e.g., information relating to: disputes and court proceedings, professional relationships and background, assets held, and transactions entered into);
  • billing information;
  • professional interests and events attended; and
  • any other information you may provide to us (e.g., if you contact us by letter, telephone, email or any other means of electronic or personal communication).

The sources of data may include clients, intermediaries, data subjects directly, third parties connected to the data subject (e.g., their employer or another service provider who provides services to the data subject), or publicly available material.

Our Purpose In Using Your Personal Data

The Firm processes your Personal Data only if and only to the extent applicable law provides a lawful basis for it to do so. The Firm may therefore process your Personal Data only:

  • if you have consented to permit us to do so;
  • if the Firm needs your Personal Data to perform the contract or provide the services that it has agreed to provide to you;
  • if the Firm needs your Personal Data to comply with a legal obligation;
  • or if the Firm (or a third party) has a legitimate interest that is not overridden by your interests or fundamental rights and freedoms. Such legitimate interests will be the providing of legal services by the Firm, administrative or operational processes within the Firm, and direct marketing.

We will use your Personal Data as follows: to deliver legal services to you and/or the institution you work or act for; to enter into client relationships; to manage its client, intermediary and other business relationships; to manage all potential conflicts of interest; to provide our contacts with marketing material, invite contacts to events that may be of interest to them, and manage such mailings and events; and to meet all of our applicable legal, regulatory and ethical obligations.

The Firm will only use your Personal Data for the purposes for which it is collected, unless we reasonably consider that we need to use your Personal Data for another reason that is compatible with the original purpose. If the Firm needs to use your Personal Data for an unrelated purpose, we will notify you and will explain the legal basis which allows us to do so.

With Whom the Firm May Share Your Personal Data

When using your Personal Data for the purposes and on the legal bases described above, the Firm may share your Personal Data with the following:

  • other providers of legal services where disclosure is necessary to fulfill the purposes set forth above;
  • any sub-contractors, agents, or service providers of the Firm;
  • courts, arbitrators, mediators, and/or other tribunals;
  • third parties with whom the Firm engages for marketing initiatives;
  • law enforcement agencies where considered necessary for the Firm to fulfill applicable legal obligations; and
  • regulators or other governmental or supervisory bodies with a legal right to the material or a legitimate interest in the material.

Transferring Personal Data From the EU To the US

The Firm is located in the United States and information the Firm collects from you will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. the Firm therefore relies on derogations for specific situations set forth in Article 49 of the GDPR. In particular, the Firm collects and transfers Personal Data from the EU to the US only in the following circumstances: with the data subject’s consent; to perform a contract we have with the data subject; to perform a contract we have with a third party that is in the data subject’s interest; to establish, exercise or defend legal claims; or to fulfill a compelling legitimate interest of the Firm in a manner that does not outweigh the data subject’s rights and freedoms.

Your Rights With Respect To Your Personal Data

You have certain rights that you can exercise under certain circumstances with respect to your Personal Data that the Firm holds. These include your rights to:

  • request access to your Personal Data;
  • request certain information related to the processing of your Personal Data;
  • correct any incorrect Personal Data maintained by LOSJG;
  • request that the Firm erase Personal Data or cease processing it;
  • object to the processing of your Personal Data;
  • withdraw any consent to processing that you previously gave; and
  • instruct the Firm to cease using your data for direct marketing purposes.

The Firm may need to request specific information from you to help confirm your identity and ensure your right to access Personal Data or to exercise any of your other rights. This is another appropriate security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it.

In many countries, you have a right to make a complaint with the appropriate data protection authority if you have concerns about how the Firm processes your Personal Data.

Fees

In general, you will not have to pay a fee to exercise any of your individual rights mentioned in this Privacy Notice. However, the Firm may charge a reasonable fee if your request to exercise your individual rights is manifestly unfounded or excessive. Alternatively, the Firm may refuse to comply with the request in such circumstances.

How Long Will The Firm Retain Your Personal Data?

The Firm will retain your Personal Data for as long as necessary to fulfill the purposes for which it was collected and processed and for the purposes of satisfying any legal, regulatory, accounting or reporting requirements.
